1) Scope of Application

1.1 These General Terms and Conditions (GTC) of DORSA Corporation GmbH (hereinafter "Seller") apply to all contracts for the delivery of goods concluded by a consumer or entrepreneur (hereinafter "Customer") with the Seller regarding the goods presented in the online shop. The inclusion of the Customer's own terms and conditions is hereby rejected unless otherwise agreed.

1.2 These GTC apply accordingly for contracts regarding the delivery of vouchers, unless otherwise specified.

1.3 A consumer is any natural person who concludes a legal transaction for purposes which are predominantly not commercial or professional.

1.4 An entrepreneur is any natural or legal person or legally capable partnership acting in the exercise of their commercial or professional activity when concluding a legal transaction.

1.5 The subject matter of the contract may be a one-time delivery or continuous delivery (subscription contract). In a subscription contract, the Seller delivers the contractually owed goods at the agreed intervals for the duration of the contract.

2) Conclusion of Contract

2.1 The product descriptions in the online shop do not constitute binding offers but allow the Customer to submit a binding offer.

2.2 The Customer submits an offer via the online order form. After adding goods to the cart and completing the process, clicking the confirmation button constitutes a binding offer.

2.3 The Seller may accept within five days by sending an order confirmation, delivering the goods, or requesting payment. The contract is concluded at the first occurrence of these events.

2.4 For PayPal payments, processing is handled via PayPal according to their User Agreement. The contract is accepted when the Customer clicks to complete the order.

2.5 For Amazon Payments, processing is handled via Amazon. Acceptance occurs when the Customer initiates payment.

2.6 The contract text is stored and sent to the Customer in text form. If the Customer has an account, they can access order data online.

2.7 The Customer can review and correct input errors before submitting the order.

2.8 The contract can be concluded in different languages as displayed in the shop.

2.9 Order processing and contact are via e-mail. The Customer must ensure the e-mail address is correct and can receive messages.

3) Purchase on Trial

3.1 If "Order for Inspection" is chosen, the contract is conditional on approval within fourteen days or lack of rejection within that period.

3.2 During this period, the Customer may examine and keep the goods for inspection. Any use beyond this is the Customer's responsibility.

3.3 If approved or not rejected, payment is due immediately, within seven days at latest.

3.4 If rejected, the goods must be returned within seven days at the Customer's expense, properly packaged.

3.5 If the Customer breaches custody or return obligations, they must compensate any resulting damage.

3.6 Statutory right of withdrawal is not affected.

4) Right of Withdrawal

4.1 Consumers generally have a right of withdrawal.

4.2 Details are provided in the Seller's withdrawal instructions.

4.3 The right does not apply to consumers outside the EU.

5) Prices and Payment Terms

5.1 Unless stated otherwise, prices include VAT. Shipping costs are shown separately.

5.2 For non-EU deliveries, additional costs (bank fees, customs) apply.

5.3 Payment methods are shown in the online shop.

5.4 Advance payment is due immediately after contract conclusion.

5.5 PayPal payment: Seller may assign claim to PayPal; credit checks may occur.

5.6 Sofortüberweisung: Payment handled via Klarna Bank AB, Customer confirms payment instruction.

6) Delivery and Shipping Conditions

6.1 Delivery to the address provided, PayPal address decisive if used.

6.2 If delivery fails due to Customer, they bear the costs unless exercising withdrawal.

6.3 Risk passes according to whether Customer is consumer or entrepreneur.

6.4 Seller may withdraw if self-supply fails.

6.5 Self-collection is not possible.

6.6 Vouchers may be delivered via download, e-mail, or post.

7) Contract Duration and Termination for Subscription Contracts

7.1 Subscription contracts continue for the agreed term and renew automatically unless terminated.

7.2 Termination must be in writing or text form within the specified notice period.

7.3 Early termination is allowed for important reasons.

8) Retention of Title

8.1 Goods remain property of Seller until full payment is made.

8.2 Customer must handle the goods carefully and inform Seller of any seizure or damage.

9) Liability for Defects (Warranty)

9.1 Statutory warranty rights apply.

9.2 For used goods, warranty may be limited if stated in the product description.

10) Liability

10.1 Seller is liable for damages only in cases of intent or gross negligence, or injury to life, body, or health.

10.2 Liability is limited to foreseeable damage typical for the contract.

11) Redemption of Promotional Vouchers

11.1 Promotional vouchers are non-transferable unless stated otherwise.

11.2 They cannot be redeemed for cash.

12) Redemption of Gift Vouchers

12.1 Gift vouchers can be redeemed once for the respective product or service.

12.2 Unused amounts cannot be paid out in cash unless legally required.

13) Applicable Law

13.1 German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

14) Place of Jurisdiction

14.1 For consumers, place of jurisdiction is the consumer's residence if permitted by law. Otherwise, Stuttgart, Germany applies.

14.2 For entrepreneurs, Stuttgart, Germany is agreed jurisdiction.

15) Alternative Dispute Resolution

15.1 The EU Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr.

15.2 The Seller is not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
